Privacy policy

What data we process

  • Website visit: IP address, technical log data, hosting data.
  • Use of the service: your WhatsApp number, submitted photos as well as text and voice messages, connected social media accounts.
  • Contract: name, company, payment data (processed via Stripe).

Purposes

Service provision, contract processing, support and fulfilment of legal obligations.

Voice messages & photos

Your voice messages and photos are processed exclusively to create your posts. They are not released for training third-party AI models and are not shared with uninvolved third parties.

Processors

We use processors, including Meta (WhatsApp Business Platform), Anthropic, Stripe as well as hosting and publishing providers. The use of US providers is based on standard contractual clauses and the Swiss-U.S. Data Privacy Framework.

Retention & deletion

We keep data only as long as necessary; statutory retention periods remain reserved (e.g. 10 years for business records). Customer content is deleted 90 days after the end of the contract.

Your rights

You have the right to access, rectification, deletion, restriction of processing, data portability and objection. A message to hoi@asklotti.ai is enough. You also have the right to lodge a complaint with the Swiss Federal Data Protection and Information Commissioner (FDPIC) or the competent EU supervisory authority.

Terms of service

1. Scope

These terms apply to all services of OptAI AG, Zurich (brand: Lotti).

2. Service

OptAI creates social media posts from the photos as well as text and voice messages submitted by the customer via WhatsApp. Posts are approved by the customer and then published on the connected channels. The scope follows the chosen subscription as per the pricing page.

3. Contract & trial period

The contract starts with a 14-day free trial period. After that, the contract converts into the chosen subscription unless cancelled beforehand.

4. Prices & payment

The published prices apply, plus VAT. Payment is made monthly or annually in advance. In case of late payment, access may be suspended after a reminder.

5. Term & cancellation

Monthly subscriptions can be cancelled at the end of the current billing period, annual subscriptions at the end of the term. Fees already paid are not refunded.

6. Customer obligations

The customer ensures that they hold the rights to the submitted content. By approving with a 👍 they authorise publication.

7. Rights to content

Customer content remains the property of the customer. Lotti receives the usage rights necessary to provide the service. Finished posts pass to the customer without restriction upon payment.

8. Availability & third-party platforms

The service depends on third-party interfaces (in particular Meta and other social media platforms). No guarantee is given for their availability.

9. Liability

Liability is limited to gross negligence and intent. Liability for indirect and consequential damages is excluded. Liability is capped at the fees paid in the last 12 months.

10. Privacy

The privacy policy applies.

11. Changes

Changes to these terms are announced with a 30-day objection period.

12. Governing law & jurisdiction

Swiss law applies. Place of jurisdiction is Zurich.
